The “Patrimonio Stabile” and Religious Congregations – Part III

The Patrimonio Stabile and Insolvency Procedures; the “Destined Patrimony” of Third Sector Entities

Generally, the “reputation” of the Stable Patrimony is not the best; it is often perceived as a merely theoretical and abstract legal concept which does not have a large scope of application, or which is not particularly beneficial for religious congregations compared to the efforts and expenditures connected with its establishment.

However, as already outlined in our previous Newsflashes, the Stable Patrimony constitutes, a useful and beneficial legal tool for safeguarding a religious entity’s economic self-sufficiency and to enable the Institute to achieve the objectives for which it was established. In fact, both the Code of Canon Law and the CICLSAL’s 2014 Guidelines for the Management of Assets, strongly emphasize the need for each religious Institute to create a formal Stable Patrimony.

DIKAOIS is committed to providing practical solutions to religious congregations for the complex legal issues they face that help them to comply creatively with their legal obligations.

That’s the reason why we shall dedicate a specific part of our upcoming workshop to the question of the protection that the Stable Patrimony offers to religious entities in the context of insolvency or other legal proceedings.

We shall also examine some of the major and fundamental differences between the Stable Patrimony compared to the “Destined Patrimony” of Third Sector Entities, such as the segregation of the patrimony and a possible limitation of liability.

We are looking forward to discussing these interesting topics with you as well as to sharing thoughts and possible action plans.
